Areas of Practice


MuNICIPAL AND GOVERNMENT

Municipal and government law includes a variety of topics including land use, land development regulations, zoning, comprehensive plan and amendments thereto, open meetings and public records laws, ordinances and resolutions, streets and roads, cell towers, utilities, constitutional issues, and all matters involving public policy and services to the public.   

During her 13 year tenure as the City Attorney for 13 years, Audrey prepared a notable amount of ordinances (laws) and plethora of contracts, including but not limited to public and private easements, development agreements, subdivision improvement agreements, encroachment agreements, franchise and lease agreements, conservation easements and right-of-way agreements.   Audrey also handled matters involving the vacating or partial vacation of alleys and roads, economic development grants/loans, collective bargaining/union negotiations, emergency matters, public transportation, all Town planning matters (development applications, conditional use permits, special permits, building code issues, new land development regulations), employment issues, licensing and software agreements, liquor law and licensing compliance, corporate law issues and practices, public policy and ethics, cell tower, sign code, airport regulations and all other municipal law matters.

Cohen-Davis Law is available to assist, guide, provide insight, evaluate and advise on processes, procedures and issues regarding local and state government, and  laws involving municipalities and local government.


Contract Formation and Disputes

Cohen-Davis Law is available to assist in drafting and creating contracts, and in evaluating and resolving disputes in connection with contracts.


Appellate

What rights exist after a trial? Cohen-Davis Law brings experience in evaluating options for an appeal from a trial and potential arguments before the appellate court. The evaluative process and the record is critical in determining the strongest legal arguments and in preparing the most effective briefs for the appellate court.



CIVIL LITIGATION

Cohen-Davis law offers twenty-five (25) years of litigation experience handling litigation matters on behalf of plaintiff’s and defendant’s involving municipal and government matters, land use and zoning, contract, construction, business, constitutional, fraud, injunctive relief and negligence claims. Cohen-Davis has handled all preliminary stages of potential litigation matters, and all pleadings, discovery, depositions, motions and trial, and has filed and argued appeals to the Wyoming Supreme Court. Cohen-Davis has successfully filed litigation matters in both state and federal courts and handled appeals in the multiple jurisdictions in which she is licensed.


Landlord-Tenant Law

Cohen-Davis Law is experienced in advising clients regarding the Wyoming state and local laws governing landlords and tenants, including the Uniform Residential Landlord and Tenant act, unlawful eviction, discrimination, property damage and damage deposits. We are also experienced in working to resolve and/or litigate contract disputes.


LOCAL COUNSEL

REAL ESTATE LAW

Your real estate / property agreement may need special clauses and a customized sale-purchase contract which a real estate agent may not have the legal expertise to do. Cohen-Davis Law will guide and advise during the course of your property case where legislation is complex and constantly changing. We will be honest and forethcoming. We will go over the risks and the costs associated with your real estate case before you encounter problems. In this way you, our goal is to save much later expenses.


LAND USE

Land use and zoning law involves the evaluation of public regulations governing the use and development of public and private real estate. The Wyoming State Legislature holds the power to authorize zoning, and local government may enact its own ordinances or resolutions in connection with a comprehensive plan or master plan determining what uses can and cannot be utilized. Zoning regulations typically divide a municipality or county into residential, commercial, and industrial zones, and address building height, bulk, lot area, setbacks, parking, signage, and density. Other legal issues pertaining to land use include easements, trespassing, and eminent domain. Cohen-Davis is available to assist and decipher land use issues.


Administrative Law

Audrey has had the unique experience of presenting and advocating before several Town of Jackson Town Councils, Town of Jackson Planning Commission/Board of Adjustment, Town Staff and other Town boards such as Energy Conservation Works, START Board and Board of Examiners.  She also worked closely with the Teton County Board of County Commissioners, Jackson/Teton County Housing Authority and other county administrative agencies, elected officials and staff.

This experience before administrative boards and staff is a skillset that Cohen-Davis Law brings to clients, including the ability to handle appeals from administrative decisions. The ability to work with all levels of administrative boards, staff and elected officials and to understand and appreciate the interplay with political positions separates Cohen-Davis from others.   Audrey has also handled arguments before Wyoming state administrative boards, including the Wyoming Equal Opportunity Employment Commission, Department of Employment/Unemployment and Workers Compensation.  


MEDIATION

Alternative dispute resolution is a way to resolve disputes prior to a trial, if possible.  As a certified mediator, Audrey is trained to assist third parties in mediation, whether court ordered or agreed to by the parties.  Her experience as a trial attorney and in negotiating dozens of settlement agreements in both private and public practice can assist parties with valuable insight to the trial and legal process involved, the benefits of mediation and resolution of a matter before trial (in some instances) and the creativity of a settlement, which is a known result.
